Sujit Choudhry; Dissects Issues Arising From Democratic Governance and Abuse of Authority

Sujit Choudhry is a Professor of Law and constitutional matters. He addresses issues to do with the design of the constitution for ensuring that societies move from violence to democratic governance. Choudhry was a Law professor based at Berkeley School of Law at the University of California. He is a renowned legal mind that has received invitations to speak in many countries. Mr. Eric Holder termed the impending termination of Robert Muller, a White House Special Counsel as a red line that was absolute. He insinuated that if something was to happen to Mr. Eric Holder, then it was necessary that demonstrations were held by the public in solidarity with Mr. Holder. He summed up his tweet by commenting that the American people needed to be heard and seen and that they were the ones to make the ultimate decisions.

In professor Choudhry’s view, the statement by Mr. Holder is loaded with two distinct ideas. He points out that the first concept is the redline symbol; which he means the clear constitutional limits in the democracy of America. The other concept is that he relinquishes his take on the matter and leaves it to the populace to make up their mind on whether the state officials have crossed the boundary mentioned and abused their authority. Furthermore, according to Choudhry, Mr. Holder is suggesting that the American People’s reaction to the matter will determine how it will be solved. In other words, they will lay the basis for either upholding the crossing of the said red line or its reversal. Mr. Eric Holder’s tweet, Professor Choudhry observes that it is based on the self-enforcement of the constitution. It suggests the premise that violation of constitutional rules is not an express signal to the courts to term them as violations per se. Professor Sujit Choudhry is surprised that despite Mr. Holder had been the nations’ chief law enforcement point man but he avoids the legal route and fails to even mention such a challenge to tackle the onslaught on Muller’s authority
